Terms and Conditions

1. Abbott Care & Share Rewards Program (“Program”) is a customer engagement program wherein customers who wish to participate in this Program can win Rewards (as defined below) subject to the following terms and conditions (“Terms and Conditions"). This Program is run by Abbott Nutrition, a division of Abbott Healthcare Private Limited (“Abbott”)

Participation in the Program is purely voluntary and free of charge. The participant will be given an Reward when participant register’s / sign’s up for the Program for the first time by scanning the QR code inside the pack of the Product (as defined below) purchased by the participant and providing and filling the required details and agreeing to the Terms and Conditions of the Program (“Participant”). Participant will also get an opportunity to win the Reward on subsequent purchases of the Product/s subject to the T&Cs. Reward shall mean a gift voucher of such amount as decided by Abbott or such other gift of such value as decided by Abbott. (Products shall mean the Abbott Nutrition Division’s products as  listed in the Schedule given in the end of these T&Cs (“Schedule”)).

2. The Program can be discontinued by Abbott at any time at its sole discretion with or without notice.

3. To participate in the Program, the Participants must be above the age of 18 years only and residing within India Only. By participating in the Program, the Participant shall be deemed to have agreed to all the Terms and Conditions of the Program as mentioned herein, including any additional rules of the Program and the conditions of winning the Reward / redemption of voucher as Abbott may specify from time to time. All information or data submitted by the Participant for participating in the Program shall be subject to Abbott Privacy Policy www.abbott.co.in/privacy-policy.html .   Participant agrees to receive communication(s) from Abbott relating to the Program and Participant unconditionally agrees not to make any claim or raise any complaint against Abbott. Abbott shall send the Rewards by email or WhatsApp on the email address / mobile number provided by the Participant at the time of registration.

Following is the modality and rules of the Abbott Care and Share Rewards Program :

To be part of the Abbott Care & Share Rewards Program , the Participant must have purchased Products stated in the Schedule.

After purchasing the Product the user is required to scan the QR code inside of the pack and register by providing Email ID, Mobile No. and Brand purchased to be eligible to get Rewards. On subsequent purchase of the Product the Participant is required to scan the inside QR code and provide registration details along with Email Id, Mobile No. and Brand purchased. The Participant is eligible for maximum 3* Rewards in 90 days period from date of last purchase.  

4. Abbott reserves the right to cancel the registration if at any time it is found that Participant provided any incorrect information or the transaction is found to be fraudulent, using illegal or unethical practice including without limiting to tampering of any system, technical error or any unauthorized access to the system.

5. Abbott reserves the right to modify the Terms and Conditions of the Program, mode of Reward, or discontinue the Program at any time without assigning any reasons, and without any prior intimation to Participants. Participants will not be entitled to any cash payment against any Reward. If any Reward is not utilized in the stipulated period of time Abbott shall not be responsible /liable to compensate the Participant in any manner for the same. Participant shall not have any right to request or demand for any specific Reward or value of Reward or change in Reward. Participant shall be solely responsible for all taxes and other expenses related to the Rewards.

6. In case of any questions regarding the Program or the Reward, Participants may contact Abbott Customer care at wecare.anindia@abbott.com or 1800-266-0448. Abbott may not entertain any correspondence which is abusive, derogatory, defamatory or otherwise unprofessional in any manner. 

7. The Reward cannot be transferred or assigned to any third person neither can it be converted in cash. No communication will be entertained in this regard.

8. The decision of Abbott in all matters relating to the Program shall be final and binding on the Participants.

9. If for any reason, the administration, security, fairness, integrity or proper conduct of the Program is affected by computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures, rules and regulations of a digital platform or any cause beyond the control of Abbott, the Program will be cancelled, modified, suspended, or any affected entry may be invalidated by Abbott, at its sole discretion.

10. Abbott may, in its sole discretion, disqualify any submissions, and prohibit any person from further participation in the Program in the event that a person tampers with, or benefits from any tampering or system error with the submission process or with the operation of the Program or acts in violation of the Terms and Conditions of the Program, or acts in a disruptive manner, or with the intent to defame, abuse, threaten or harass any other person, or for any other purpose which, in Abbott’s sole assessment, hampers or disturbs the conduct of this Program.

11. By registering for the Program the Participant accepts the conditions stated in these Terms and Conditions of the Program, and agrees to be bound by the decisions of Abbott, warrant that the Participant is eligible to participate in the Program and release Abbott from and against all claims, actions and damages arising in connection with his/her/their participation and/or entry and/or selection of the Reward winners.

12. Any attempt to deliberately damage; or undermine the legitimate operation of the Program shall be deemed to be a violation of the Terms and Conditions of the Program and, should such an attempt be made, Abbott reserves the right to seek damages or other remedies from any such person(s) responsible for any such attempt to the fullest extent as permitted by law.

13. The Participant agrees to indemnify and hold harmless Abbott and its affiliates, and each of its and their officers, directors, employees, consultants, licensors, agents, and representatives from and against any and all claims, losses, damages or liability that may be asserted against or incurred by any of them at any time, in connection with entry, or participation or use of the Program, or by  Participant’s breach of any agreement or warranty associated with the Program.

14. Participation in this Program is at the sole discretion of the Participant. Should a Participant not wish to continue to participate in this Program pursuant to the prevailing Terms and Conditions of the Program as amended, he/she/they may discontinue or terminate his/her/their participation in the Program upon written notice to Abbott.

15. Abbott and its affiliates and associates will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Program or the acceptance or use of the Reward/vouchers. It is clarified that the vouchers shall be accepted by the Program winner in the form and manner provided by Abbott, and Abbott shall not be liable for any loss or damage related thereto. Abbott shall not be liable or responsible for any delay in dispensing the Reward to the Participant. Abbott is facilitating the Rewards through its vendor. The warranty of such Reward will be covered by the respective brand owners’ / manufacturer’s warranty terms and condition. In any circumstances, Abbott will not be responsible for quality/service related to the Reward.

16. Abbott shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, epidemic, pandemic, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, acts of God, restriction on usage of any digital media platform, systemic electrical, telecommunications, network or other utility failures or any other circumstances which are beyond Abbott’s control.

17. Neither Abbott nor any of its respective parent company, subsidiaries, affiliates and each of their respective officers, directors, shareholders, agents and employees, nor any agencies are responsible for incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, lost/delayed/misdirected mail, omission, interruption, deletion, defect, line failure of any telephone or other network, computer equipment, software or any combination thereof, or for late, lost, damaged, misdirected, incorrect or incomplete entry.

18. The use of any automated launching or entry software or any other mechanical or electronic means that allows a Participant to automatically enter in the Program repeatedly is prohibited and any such participation shall be deemed to be invalid. Abbott reserves its right to cancel such Participant’s registration and also bar any such users from participating in any of its program/s in future.

19. The Program is governed by laws of India and is subject to all applicable laws. Decision of Abbott as to the interpretation of any clause under these Terms and Conditions of the Program shall be final and binding on the Participant.

20. If the Participant use or access the Program from outside India, they do so at their own risk and are responsible for compliance with the laws of such jurisdiction. The Program or the Terms and Conditions of the Program do not constitute, nor may it be used for or in connection with, any promotional activities or solicitation by anyone in any jurisdiction in which such promotional activities or solicitation is not authorized or to any person to whom it is unlawful to promote or solicit.

21. The acceptance of the Terms and Conditions of the Program shall be deemed to have been given at Mumbai, Maharashtra, India and the courts in Mumbai alone shall have exclusive jurisdiction to entertain any proceedings in any way relating to or concerning these Terms and Conditions of the Program or any rights, duties, obligations or liabilities arising there under to the exclusion of all other courts in India.

22. This document is an electronic record in terms of the Information Technology Act, 2000 (“IT Act”) and rules made thereunder as may be applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the IT Act. This electronic record is generated by a computer system and does not require any physical or digital signatures.

Unless the Program is terminated or suspended by Abbott earlier, the Program shall be valid only until the stocks of the Product mentioned in Schedule covered under the Program lasts.

Abbott may amend, update, extend, change, terminate, cancel, suspend etc. the Terms and Conditions hereof without any further notice and its decision shall be final in this regard.

Failure by Abbott to enforce any of its right at any stage does not constitute a waiver of those rights.

Schedule – List of eligible Products:

The products which are eligible for the program are ENSURE VANILA 200 GM BIB and ENSURE CHOCOLATE 200 GM BIB

BIJ (Jar packs) and Sachets are not eligible for the program.
